Court Orders Edo Speaker to Swear in Eruaga or Face Prison

Mr Sylvanus Eruaga, of the Peoples Democratic Party (PDP) should be immediately sworn-in as a member representing Etsako West 11 constituency in the state legislature. This was ordered by the Court of Appeal in Benin, Edo State, after Edo State House of Assembly refused to swear him in referring to current investigation of Eruaga’s alleged forgery of certificate of return.

Speaker of the House, Victor Edoror, should obey the court’s ruling or be guilty of contempt of the court and face prison sentence. In Form 48 titled “notice of consequences of disobedience of court order,” filed against the Speaker and the Clerk of the Edo State House of Assembly, Mr. Lawson Ugiabe stated:

“Take notice that unless you obey the directions contained in the judgment/order of this court dated December 19, 2015 (enrolled order attached) by swearing in the appellant/judgment creditor as the member to represent Etsako West Constituency 11 in the Edo State House of Assembly, you will be guilty of contempt of this court and will be liable to be committed to prison.”

It would be recalled that the Court Appeal had already declared Eruaga winner of the Etsako West II constituency in the April 12, 2015 general election. Besides, it asked Yakubu Gowon of the All Progressive Congress (APC) to vacate the seat for Eruaga.
